The Unusual Complications Associated with the Trifecta of FMLA/ADA/WC Leave

Session Description

Employers regularly cite employee leave requests as one of the most perplexing and confusing issues they face on a regular basis. This presentation will help untangle the web of leave laws – including FMLA, ADA and Workers’ Compensation laws – and assist employers in developing strategies for dealing with extended leave requests, multiple extensions of leave, and potential abuse of protected leave time by employees.

Learning Objectives

  1. Develop an understanding of the legal requirements for granting leave in a variety of workplace situations.
  2. Understand the interplay between the FMLA and ADA when considering employee leave requests.
  3. Identify risk management strategies when making termination decisions regarding employees who have requested or taken protected leave.

 

Melody Rayl

Melody is Partner in the Kansas City office of Fisher & Phillips. Melody counsels and advocates for private and public-sector employers in all aspects of employment litigation and traditional labor law. She works with employers in defending a broad variety of employment related claims before state and federal courts and administrative agencies. Melody also assists clients in opposing labor union organization activities and during collective bargaining negotiations.

Melody has been named a Missouri and Kansas Super Lawyers Rising Star for seven consecutive years. Prior to engaging in the practice of law, Melody served 6 years on active duty in the U.S. Army, 20 years as a law enforcement officer, and several years teaching undergraduate coursework as both a full-time and adjunct college faculty member. She also spent one year as a United Nations police advisor in post-war Bosnia, where she supervised the Internal Affairs Investigation Unit.
